National Business Names Reg.

Publication Date: 7 February 2012

It is anticipated the National Business Names Registration System will commence on 28 May 2012. Existing businesses do not need to do anything to transfer their business name to ASIC upon the new national system launch. Their existing state and territory business name registration will automatically transfer into the new national business name register.

The purpose of business name registration is to allow consumers to ascertain who is behind a business name.  Registration of a business name, company name or domain name does not in itself give any proprietary rights (property rights).  A registered Trade Mark can give this protection.  IP Australia's TM Check can help business name applicants more easily identify pending and registered trade marks which may be similar or identical to their proposed business name.  Further information on trade marks can be found at www.ipaustralia.gov.au
